IMPORTANT NOTICE

Để đủ điều kiện nhận Giải thưởng, một cú đánh Hole-in-One (sau đây gọi là “HIO”) phải được báo cáo kịp thời, có người chứng kiến đầy đủ, được ghi lại và xác minh theo đúng các Điều khoản và Điều kiện dưới đây. Vui lòng tham khảo Mục 5 – Quy trình thông báo HIO để được hướng dẫn chi tiết.

Việc báo cáo trễ, cung cấp tài liệu không đầy đủ hoặc không tuân thủ yêu cầu xác minh sẽ dẫn đến việc mất quyền nhận giải thưởng, bất kể lý do. Người tham gia được khuyến nghị tìm hiểu kỹ tất cả các yêu cầu trước khi tham gia.

Các điều khoản và điều kiện của Thỏa thuận này (sau đây gọi là “Thỏa thuận”) quy định các quy tắc cụ thể điều chỉnh Dịch vụ Giải đấu Hole-in-One (sau đây gọi là “Dịch vụ”) do Công ty Cổ Phần Đầu Tư VGP Việt Nam (sau đây gọi là “VGP”) tổ chức và áp dụng cho tất cả Người tham gia.

Theo quy định của Thỏa thuận này, Người tham gia được xem là đã chính thức tham gia Dịch vụ Giải đấu Hole In One kể từ khi hoàn tất đăng ký và hoàn thành lượt chơi golf theo các Điều khoản và Điều kiện tại đây, không phụ thuộc vào việc giải đấu có được tổ chức dưới hình thức một giải đấu tập trung hay không.

Bằng việc đăng ký và tham gia Dịch vụ, Người tham gia xác nhận rằng họ đã đọc, hiểu và đồng ý tuân thủ tất cả các điều khoản và điều kiện được nêu tại đây.

VGP có quyền sửa đổi, bổ sung hoặc cập nhật các Điều khoản và Điều kiện của Thoả thuận này này bất kỳ lúc nào mà không cần thông báo trước. Người tham gia được khuyến nghị thường xuyên xem phiên bản mới nhất của Điều khoản và Điều kiện tại trang web của VGP tại golfprizes.vn hoặc tại các khu vực đăng ký được chỉ định trước khi sử dụng Dịch vụ.

1. Definitions

Theo Thỏa thuận này, các định nghĩa sau sẽ được áp dụng:

Hole-in-One (hereinafter “HIO”):HIO là cú đánh từ khu vực phát bóng của một hố mà bóng rơi vào lỗ chỉ với một cú đánh, không có sự trợ giúp hoặc vi phạm bất kỳ quy tắc nào theo quy định của ban quản lý Sân Golf. HIO phải diễn ra tại hố par-3 được chỉ định chính thức cho Dịch vụ thi đấu Hole-in-One và phải được chứng kiến và xác nhận bởi tất cả các gười chơi cùng nhóm (flight) tại thời điểm thực hiện cú đánh.

Hole-In-One Contest:Là dịch vụ do VGP tổ chức tại các Sân Golf được chỉ định, trong đó những Người tham gia đã đăng ký thi đấu để giành Giải thưởng bằng cách thực hiện HIO theo các quy tắc và thủ tục được nêu trong Thoả thuận này.

Register:An individual who registers to participate in the Service on their own behalf and/or on behalf of other Participants. The registrant is responsible for providing accurate information and ensuring compliance with the requirements for Service registration.

Participant:Là cá nhân đã được đăng ký tham gia Dịch vụ, bởi chính họ hoặc bởi Người đăng ký, và do đó đủ điều kiện sử dụng Dịch vụ theo các Điều khoản và Điều kiện của Thỏa thuận này.

Certificate of Hole-in-One Contest:Là tài liệu chính thức do VGP cấp cho Người đăng ký sau khi đăng ký thành công. Tài liệu xác nhận sự tham gia của Người tham gia trong một Dịch vụ cụ thể và bao gồm các thông tin như ngày thi đấu, Sân Golf và Giải thưởng. Giấy chứng nhận này được sử dụng làm cơ sở để xác nhận quyền tham gia và nhận Giải thưởng.

Golf Course:Refers to the golf course venue at which the Contest is organized and conducted by VGP.

Contest FeeRefers to the fee paid by a Participant to VGP in order to register and participate in the Contest.

Prize:Refers to the award designated by VGP to a Participant who wins a HIO

Flight:Refers to the group of golfers playing together in the same round.

Working Day:Là ngày trong tuần không bao gồm Thứ Bảy, Chủ Nhật và các ngày lễ theo quy định của Bộ luật Lao động Việt Nam và các văn bản pháp luật có liên quan.

2. Eligibility

Người tham gia phải đủ tuổi hợp pháp để tham gia vào Thỏa thuận này và không bị cấm theo pháp luật Việt Nam khi sử dụng Dịch vụ. Trường hợp Người tham gia là người chưa thành niên hoặc bị hạn chế năng lực pháp luật, phải có sự đồng ý trước từ người giám hộ hợp pháp.

Participants must play on a flight consisting of at least 3 golfers on a Contest Day to register for a Contest.

The following individuals are not eligible for a Contest:

• Golf Course Director/Club Manager/Staff of the Golf Course
• Thành viên của bất kỳ hiệp hội golf chuyên nghiệp nào tại bất kỳ thời điểm nào, bao gồm nhưng không giới hạn bởi Hiệp hội Golf Chuyên nghiệp (PGA).

3. Contest Registration and Contest Conditions

3.1. Contest Registration

An Applicant who wishes to register for a Contest Day must provide the following information at least 15 minutes before the actual tee time:

• Full name of Applicant
• Mobile Phone or Email address of Applicant
• Full name of all Participants
• Courses Played (in case the Golf Course has 27 or more holes)

Sau khi đăng ký thành công, Người đăng ký sẽ nhận được Giấy chứng nhận Dịch vụ Giải đấu Hole-in-One do VGP cấp thông qua email hoặc số điện thoại đã đăng ký.

The Applicant is responsible for ensuring all information provided for all participants is accurate. Once a Certificate of Hole-in-One Contest is issued, no modification is allowed unless the date of issuance of such Certificate is at least 24 hours prior to the tee time of the Contest. The request for modification shall be submitted to VGP via email at

The Registrant is responsible for informing all registered Participants of the Terms and Conditions of this Agreement and ensuring their compliance.

-If a Participant does not participate or cancels their participation in the Contest for any reasons, including health concerns, weather conditions, or personal matters, VGP shall not refund the Contest fee.

3.2. Contest Conditions

-Each participant is entitled to only one valid stroke per designated par-3 hole. No retries or practice shots are permitted.

-The position and the grass area at the designated hole must not be altered or specially arranged from the standard conditions of regular play, nor positioned in a manner facilitating a HIO.

-The golf ball used must conform to recognized standards set by golfing regulatory authorities.

4. Prize Payment Conditions

-A successful HIO must be witnessed and certified by all co-players from the same flight, using the form provided or approved by VGP to be eligible for Prize payment.

-All Prizes awarded by VGP are non-transferable and are only paid in Vietnam Dong. The HIO winner, whether Vietnamese or foreign national, must hold a valid bank account in Vietnam. If the winner does not have such an account, a notarized authorization must be provided designating a recipient with a valid bank account in Vietnam to receive the Prize on their behalf.

-The prize awarded to the HIO winner is subject to personal income tax in accordance with applicable laws. VGP will deduct and pay the tax on behalf of the winner at the time of prize payment, as required by regulations.

If the HIO winner registers for more than one Contest with VGP, only the Contest with the highest Prize value will be awarded unless otherwise expressly provided.

By accepting the Prize, the HIO winner grants VGP the right to use his/her name and photographs for VGP’s marketing and promotional purposes, without additional compensation.

5. HIO Reporting Procedure

Upon achieving a HIO, the winner must follow the reporting procedures below. Any failure to provide timely reporting shall result in forfeiture of the Prize, and VGP shall not be obligated to accept or consider any justification for the delay or inaction.

Step 1. Photo Submission

Người ghi HIO phải truy cập ngay và chụp, tải lên hai (2) ảnh sau trên đường link https: //golfprizes.vn/report,

• One individual photo at the HIO winning hole.
• One group photo with all co-players from the same flight at the HIO winning hole.

Step 2. Golf Course Notification

The HIO winner must immediately report the achievement to the Golf Course management and adhere to the Golf Course's procedures for verifying and documenting the HIO.

Step 3. VGP Notification

Không muộn hơn 30 phút sau khi ghi HIO, Người ghi HIO phải thông báo cho VGP bằng cách gọi tới đường dây nóng 088 608 1842. VGP sẽ xác nhận thông báo và cung cấp thêm các chỉ dẫn (nếu cần thiết).

6. Submission of Prize Claim Documents

Trong vòng 10 ngày làm việc kể từ khi ghi HIO, người ghi HIO phải nộp đầy đủ bộ hồ sơ nhận Giải thưởng bao gồm:

• A notarized copy of a valid Citizen Identification Card
• A scanned copy of the Hole-In-One Confirmation Report issued by the golf course
• A scanned copy of the official Hole-In-One Certificate issued by the golf course
• A completed Prize Claim Form using the official VGP template

The winner shall cooperate with VGP and provide any additional information or documentation reasonably requested to facilitate the verification and processing of the Prize claim.

VGP shall process the Prize payment within 15 working days from the date of receipt of all claim documents.

7. Prize Denial

VGP will not make any Prize payments under the following circumstances:

• Prize Claimants who have not paid the contest fee in accordance with VGP's prescribed procedures
• Any violation of applicable laws, or breach of the rules and regulations of the Golf Course by the Prize claimant.
• Gian lận, khai man, lừa dối, hoặc hành vi sai trái có chủ đích bởi người yêu cầu Giải thưởng hoặc của bất kì người làm chứng nào;
• Any breach of any Terms and Conditions of this Agreement by the Participant or any party involved in the claim.

Any misrepresentation of fact by the Prize claimant, whether intentional or unintentional, shall constitute sufficient grounds for forfeiture of the Prize.

VGP có quyền tiến hành điều tra kĩ lưỡng và thực hiện các biện pháp pháp lý cần thiết khi có sự nghi ngờ hợp lý về các hành vi gian lận. Trong trường hợp có sơ sở nghi ngờ hợp lý về gian lận, VGP có quyền tạm hoãn thanh toán Giải thưởng để xác minh thêm.

8. Privacy

VGP is committed to protecting the privacy and personal information of all Participants in accordance with applicable laws and regulations of the Socialist Republic of Vietnam.

Dữ liệu cá nhân được thu thập trong quá trình đăng ký Dịch vụ và yêu cầu Giải thưởng (bao gồm họ tên, thông tin liên hệ, giấy tờ tùy thân và hình ảnh) sẽ chỉ được sử dụng cho mục đích tổ chức Dịch vụ, xử lý chi trả Giải thưởng, mua bảo hiểm HIO và (nếu được đồng ý) hoạt động quảng bá.

VGP có thể chia sẻ thông tin cá nhân với bên thứ ba đáng tin cậy, bao gồm công ty bảo hiểm và các nhà cung cấp dịch vụ khác, chỉ nhằm mục đích thực hiện bảo hiểm HIO và nghĩa vụ liên quan đến Dịch vụ. Các bên này được yêu cầu phải tuân thủ quy định bảo mật thông tin theo pháp luật.

Bằng việc tham gia sử dụng Dịch vụ, Người tham gia đồng ý cho phép thu thập, xử lý và chia sẻ thông tin cá nhân theo nội dung tại Điều khoản Bảo mật này.

9. Choice of Law and Dispute Resolution

This Agreement is governed and interpreted in accordance with the laws of Vietnam.

Mọi tranh chấp phát sinh sẽ được VGP và Người tham gia nỗ lực giải quyết thông qua thương lượng thiện chí. Trường hợp không đạt được thỏa thuận, tranh chấp sẽ được chuyển đến tòa án có thẩm quyền để giải quyết theo quy định pháp luật.
